Twitter Party Sweepstakes Rules
From time to time, Sponsor(s) will work with Stiletto Media on a Twitter Party Giveaway Sweepstakes (the “Sweepstakes”).
Sweepstakes are in no way sponsored, endorsed or administered by, or associated with Twitter. Twitter is completely released of all liability from each participating Sweepstakes entrant. Entrant’s participation is acknowledgement of the same. Any questions, comments or complaints regarding the Sweepstakes must be directed to the Sponsor, not Twitter.
All federal, state and local laws and regulations apply; void where prohibited. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Odds of winning depend upon the number of eligible entries received per Sweepstakes.
ELIGIBILITY: The Sweepstakes is open only to individuals, 18 years or older at time of entry, who are legal residents of the fifty (50) United States and the District of Columbia and who are physically located and reside in the United States or District of Columbia. Void in Puerto Rico and where prohibited. Employees of Stiletto Media, Sponsor and their respective parent companies, affiliates, subsidiaries, employees, directors, officers, franchisees, agents and their immediate families (defined as parents, children, siblings, spouse and grandparents), and those domiciled with any of the foregoing are not eligible.
TO ENTER: To enter, you must have or create a Twitter account (“Twitter account”). If you already have a Twitter account, submit your email address and password and sign into Twitter during the Sweepstakes. If you are not an existing member of Twitter, you will be required to follow the directions and join Twitter. When you join Twitter, you are indicating that you have read and agree to accept the Twitter Terms of Service and Privacy Policy. Membership to Twitter.com is free. There are 2 ways to enter a Sweepstakes:
- Participant must be an existing follower of @StilettoChat on Twitter, must follow Sponsor and any other indicated Twitter accounts, must RSVP, must attend the Sweepstakes during the stipulated date and time and must participate in the conversation during the Sweepstakes by Tweeting with the appropriate hashtag.
- Participant must sign in at Twitter.com, go to www.twitter.com/StilettoChat and become a new follower by clicking “Follow” @StilettoChat during the Sweepstakes Period. Participant must also follow the Sponsor and any other indicated Twitter accounts, must RSVP, must attend the Sweepstakes during the stipulated date and time and must participate in the conversation during the Sweepstakes by Tweeting with the appropriate hashtag.
Entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Entries that are mechanically reproduced, copied, illegible, incomplete, late or inaccurate are void. Sponsor is not responsible for late, lost, incomplete illegible, damaged or misdirected entries. Incomplete entries or entries not complying with these Rules are subject to disqualification, at the Sponsor’s sole discretion. Sponsor’s decisions are final on all matters relating to the Sweepstakes. Entries will be deemed to have been submitted by the authorized account holder associated with the username used to enter via Twitter. The authorized account holder is defined as the natural person who is assigned to a username by twitter.com. You must enter using only a twitter.com account subscribed to and registered in your name. Entries will be deemed to have been submitted by the person subscribed and registered to the username from which entries are received. The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the user name/Twitter Account associated with the winning entry. Entry must be in keeping with the Sponsor’s image, and may not be offensive, nor can it defame, or invade upon the publicity rights or privacy of any person or otherwise infringe upon any person or entity’s intellectual property, personal or proprietary rights, as determined by Sponsor in their sole discretion. Sponsor reserves all rights, including the right to edit, publish, use, adapt, modify, or dispose of any entry, proper names, likenesses, and photographs for advertising and promotional purposes in all media (including, but not limited to, the internet) without additional compensation, except where prohibited by law.
WINNER SELECTION: On or about the date of the party, a random drawing from all eligible entries will be conducted under Sponsor’s supervision. A Sponsor’s decision is final on matters relating to Sweepstakes. Potential winner will be notified via Twitter, during the Sweepstakes, or via twitter within 24 hours of the Sweepstakes. Potential winners may be required to sign an affidavit of eligibility/liability release and where legal, a publicity release, and Federal and State tax release, or to verify their mailing address and return these documents, properly executed, within 7 days of issuance of notification. Non-compliance within this time frame, or if prize or prize notification is returned as undeliverable, will result in the entrant being disqualified, and the prize will be awarded to a potential alternate winner. Allow 8-12 weeks for delivery of prize. Odds of winning depend upon the number of eligible entries received for each Sweepstakes.
PRIZES: Individal Sponsor determines prize(s).
PRIZE AWARDS: Prizes will be awarded 8-12 weeks after winner verification. No prize substitution or transfer is permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any reason. All taxes and any other incidental expenses on prizes are the sole responsibility of each winner.
GENERAL RULES & LIMITATIONS: Entry and acceptance of prize constitute permission to use each winner’s name, prize won, hometown and likeness for print publication, online posting, and any other promotional purposes without further compensation, except where prohibited by law. By participating in the Twitter Party Giveaway, you agree to release Stiletto Media, Sponsor and their respective parent companies, affiliates, subsidiaries, employees, directors, officers, franchisees and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use, or misuse of any prize. Sponsor is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Sweepstakes, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, in any Sweepstakes-related materials, or that may limit prize fulfillment or a participant’s ability to enter the Sweepstakes. Sponsor reserves the right to permanently disqualify from the Sweepstakes any person it believes has intentionally violated these official rules. As permitted by law and in accordance with the Sponsor’s Privacy Policy and Terms of Service, Sponsor may use information provided by entrants to send announcements about the Sponsor’s products and programs via electronic and ordinary mail.
ALL ELIGIBLE PARTICIPANTS ACKNOWLEDGE AND AGREE THAT ALL ENTRIES SUBMITTED IN CONNECTION WITH THIS SWEEPSTAKES ARE SUBMITTED ON A NON-CONFIDENTIAL AND NON-PROPRIETARY BASIS AND MAY BE USED BY SPONSOR, ITS AGENTS AND SUBSIDIARIES, FOR ADVERTISING AND PROMOTIONAL PURPOSES INCLUDING (BUT NOT LIMITED TO) IN CONNECTION WITH THE SWEEPSTAKES.
DISPUTE RESOLUTION: Except where prohibited by law, by entering you agree that: (i) all issues and questions concerning the interpretation, validity, and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of New York, without regard to its rules on conflicts of law; (ii) any action at law or in equity arising out of or relating to this Sweepstakes, or awarding of the prizes, shall be filed only in the state or federal courts located in the State of New York, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action; (iii) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; (iv) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event attorneys’ fees; and (iv) you hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
